We are pleased to invite you to our annual Hot Topics in Pensions Law, hosted and presented by Burges Salmon LLP. During the seminar, Practice Development Lawyer Catrin Young and Senior Associate Kate Granville Smith will cover:
- Correcting benefit underpayments: Rectifying past underpayments for members is a common issue for all pension trustees and their advisers, particularly in the context of ongoing exercises in relation to GMP equalisation. We will run through the line of cases that has emerged since the Lloyds Bank judgment in 2018, including this summer’s case of CMG Pension Trustees Limited v CGI IT UK Limited, and cover whether members’ claims for underpayment of benefits may be time barred and/or forfeited under scheme rules. We will also offer some practical advice on advising trustees on exercising their discretion whether to forfeit benefits and in agreeing what interest should be paid on any arrears due.
- ESG: what does it mean for you and your clients? ESG is gaining prominence amongst the wider public and scheme members with recent legal cases being brought against the UK Government to explain how its net zero policies will reach emission targets, against the trustee directors of the trustee directors of the Universities Superannuation Scheme in relation to their failure to divest from fossil fuels and by two charitable trusts in relation to their adoption of a policy that aligns their charities’ investments with prioritising climate change outcomes. We will cover the ESG considerations for all schemes, regardless of size, including what are trustees’ fiduciary duties, what are TPR’s expectations and considerations for trustees when appointing investment consultants and asset managers as well as tips on drafting adviser terms of engagement to ensure the delivery of climate solutions.
